Do You Legally Need Workers’ Compensation Insurance in South Carolina?

The subcontractor trap: Even if your own crew is under 4 people, a general contractor can still require you to carry workers’ comp before they’ll hire you — and whether you’re required to carry it independent of that is determined case-by-case. The 1099 misconception: Paying your crew on a 1099 does not automatically exempt you from workers’ comp requirements. South Carolina looks at the actual working relationship, not just how payment is structured.
